Alan A. Frydenlund protects lenders by perfecting their security, safeguarding their security from intervening claims, and by realizing on their security.
As a solicitor Alan acts for clients on various aspects of lending transactions with particular emphasis on representing lenders and borrowers on syndicated secured debt financings for all matter of lending transactions. As a barrister Alan conducts realization proceedings, including residential and commercial foreclosures, receiverships and acting for clients in proceedings under the Companies’ Creditors Arrangement Act and the Bankruptcy and Insolvency Act. Alan has conducted realization litigation in Courts in British Columbia, Alberta, Ontario and the Yukon Territory.
Alan has written and presented on legal topics for Continuing Legal Education and the Professional Legal Training Course. Additionally Alan has tendered expert evidence to the British Columbia Supreme Court on financing transactions.
Alan’s clients include Canadian Chartered Banks, Foreign Banks, Trust Companies, Savings and Loan Companies, Finance Companies, Life Insurance Companies, Crown Corporations, Mortgage Investment Corporations, Credit Unions, Pension Funds, REITs, Receivers, Trustees, Real Estate Developers, Hotels, Time Share Corporations, lawyers and high net worth individuals.
Since his call to the bar in 1983, Alan has been involved in some of British Columbia’s more significant financings and Canada’s more significant security realizations both involving assets in real estate development (including construction), resorts (including hotels and time shares), the forest industry, marine industry, manufacturing and knowledge-based industries.
Alan is a former director of, and corporate secretary to, Interlaw, an international network of corporate and commercial independent law firms in some 125 cities worldwide. Alan is former chair of Interlaw’s Banking, Finance and Insolvency Special Business Team for the North America Region. He is also a Director of a number of private companies, including three Mortgage Investment Corporations and is a former Director of Glacier National Life Insurance Company.
Alan is a former President and director each of the Norwegian Old People’s Home Association and the Normanna Foundation.
